If the police do not see any evidence of alcohol use, they can still charge for Operating Under the Influence of Drugs, including marijuana. THIS DOES REQUIRE PARTICULAR EVIDENCE, AND IT MAY NOT BE POSSIBLE FOR THE COMMONWEALTH TO PROVE THIS CHARGE IN A COURT OF LAW. The prosecution will often attempt to present so-called “drug recognition experts” to testify against someone accused of driving while under influence of drugs. We will challenge any efforts to call such a witness at trial.
